Fisher Maas Howard Lloyd & Wheeler, throughout its history, has represented numerous insurance companies and their insureds under a wide spectrum of insurance policies including Commercial General Liability, Personal and Commercial Auto, Homeowners, Environmental, Property, Business Risk and Interruption, and many other specialty policies. Our insurance practice includes:
Insurance Coverage – Several of the Firm’s attorneys concentrate their practice on matters involving the interpretation of insurance policy coverages and their exclusions. Our experience in coverage includes addressing issues such as pollution exclusions, UM/UIM, molestation, “your work” exclusions, and “expected or intended” injuries. Our attorneys provide the Firm’s insurance clients with fast and thorough coverage opinions addressing the application of their policy terms to specific facts and governing law. They frequently litigate coverage issues in Declaratory Judgment actions before Indiana’s state and federal courts and are often able to resolve coverage issues through dispositive motions. Essentially, if it is in your policy, we have analyzed it.
Insurance Defense – Many of the Firm’s attorneys are experienced third party insurance defense litigators who have represented insured clients in state and federal courts across Indiana in matters ranging from simple vehicle accidents to catastrophic losses of all types. We have successfully defended just about every type of loss that can be insured under an insurance policy from minor trip and falls to complex environmental and construction matters involving numerous parties. Our defense attorneys work closely with insurers and their insureds to resolve these cases in the most efficient manner possible.
Bad Faith – Indiana’s bad faith law is constantly evolving. For this reason, and because of the extent of damages that can be assessed against an insurer under this law, the majority of coverage actions filed in Indiana include bad faith claims. For over 25 years, the Firm’s attorneys have defended its insurer clients against bad faith claims and have extensive experience in addressing the issue by dispositive motions, declaratory actions, and, if necessary, appeal. We also offer advice to our clients as to the best methods to avoid bad faith claims within the state as changes in the law occur.
Arson and Insurance Fraud – Several of the Firm’s attorneys have extensive backgrounds in insurance fraud matters including arson and theft. Our attorneys can provide assistance in coordinating arson and fraud investigations, in working with investigators and retaining fire loss experts. Our fraud attorneys are practiced at conducting detailed and thorough examinations under oath and at working with adjusters to address their needs through these examinations.
